EDDIE H. WALKER, JR. The 118th ArkBar Annual Meeting is just around the corner. The Association joins the Judicial Council in Hot Springs June 15-18 for our annual event. The plenary speaker will be Travis T. Tygart, CEO of the United States Anti-Doping Agency. He will provide insight regarding the problem of athletes using performance-enhancing drugs. His talk will include comments about the case against Lance Armstrong. Tygart’s work emphasizes that integrity still matters and that one can still win competing fairly. Professor Kimberly Norwood, from Washington University School of Law, will speak on the very timely topic of “Implicit Bias.” She will identify and discuss factors that we unconsciously consider when interacting with each other. Considerable discussions will occur regarding the issues that face our judiciary. Chief Justice Howard Brill, Judge Dan Kemp, recently elected to become Chief Justice, and former Justice Robert Brown are among the speakers who will address some of these issues. Although the CLE offerings are amazing, the opportunity for lawyers and judges to interact in an informal setting is even more valuable. Social events such as the Presidents’ Reception, the Bar Foundation Dinner and the time-honored Friday Firm Reception in the lobby of the Arlington Hotel are opportunities to renew old friendships, strengthen existing relationships and create new ones. I thank Aaron Squyres for his magnificent work as our annual meeting chair. When you see him, please express your gratitude for a job well done. Many have lost confidence that integrity still matters and that you can still truly win competing fairly. This talk will explore this cultural shift in sports and provide insight to the work of the independent National Anti-Doping organization, the United States Anti-Doping Agency (USADA), and its mission to protect the rights of those athletes competing fairly and to ensure a playing field free of performance-enhancing drugs for all competitors.

Overcoming Obstacles to Success at the 2016 ArkBar Annual Meeting

W

elcome to the 118th Annual Meeting of the Arkansas Bar Association. This year’s theme is Overcoming Obstacles to Success. Those obstacles could include implicit bias, a lack of business knowledge or experience in managing a law practice, or a lack of substantive knowledge of certain areas of the law. This year’s speakers will give you the practical knowledge to overcome all of them. Our keynote speaker is Travis Tygart, the CEO of the U.S. Anti-doping Agency who led the investigation of Lance Armstrong. Professor Kimberly Norwood will discuss implicit bias in jury selection. Paul Unger will present on law office efficiency, law office operations management, and billing. Mac Fulfer will be speaking on the art of face reading applied to client interaction, witness examination, and jury selection. He will also have a booth set up in the Exhibit Hall and will be doing free face

The Sol Def Band will be jamming on Thursday night, and our new Wednesday afternoon Welcome Reception will allow first-time attendees to mix and mingle with the veterans. Your participation in the Annual Meeting is the lifeblood of the event, and I hope you take advantage of all that it has to offer.

The registration desk is in Exhibit Halls C & D in the Hot Springs Convention Center. Pre-registered attendees will receive a link to the course materials, including the online evaluation, prior to the meeting. Members can access course materials and event schedule on the ArkBar Events app. There will be a CLE materials dowloading station in the lounge area of the Exhibit Hall. The dress for the meeting is casual.

CLE CREDIT To meet the Supreme Court’s requirements for 2015 - 2016, you must attend 12 hours by June 30, 2016, including 1 hour of ethics. 46.75 CLE credits, which includes 13 ethics hours and 7 ad litem hours have been approved for this year’s Annual Meeting. You can earn up to 21.75 hours including ethics.

The face is the most sophisticated low-tech biometric known to man. Our face records our personal history, personality profile, preferences and decision making style. This session will explain the scientific validation for face reading and demonstrate with volunteers the type of information that can be seen on a face. The discussion will include the neuroscience breakthroughs of mirror neurons, pattern recognition, reality perceptions, zombie programs, genetic programming and epigenetic alterations, as well as the communication breakthroughs that are possible with face reading. This presentation will introduce participants to a new and faster way to accurately evaluate potential jurors using physiognomy.

Panel discussion with retired Arkansas Associate Justice Robert Brown, Retired Judge David A. Stewart and David Sachar, Executive Director of the JDDC, of the issues surrounding the impact of money in judicial elections since the U.S. Supreme Court decision in Citizens United v. FEC in 2010; the debate of judicial appointments versus judicial elections in light of changes brought on by the impact of dark money and unlimited independent expenditures; and collateral issues.

This talk will explore this cultural shift in sports and provide insight to the work of the independent National Anti-Doping Organization, the United States Anti-Doping Agency (USADA), and its mission to protect the rights of those athletes competing fairly and to ensure a playing field free of performance-enhancing drugs for all competitors. This talk will provide an inside view of USADA’s investigation into professional cycling and the legal case against Lance Armstrong and other professional cycling athletes; it will also show how this effort confirms that competing fairly with integrity in sports or business still matters and is the only way to truly win.

This presentation will briefly explore implicit biases in American society, in the daily lives of the attendees, and will ultimately turn to implicit bias as it manifests in the legal profession. This will include information about how lawyers are hired, paid, mentored, evaluated and promoted, how judges are evaluated, and how jurors are selected. The presentation will suggest that unchecked implicit bias may be cause for ethical concern among the profession.

CANCELLATIONS: Full refunds, less a $50 administrative charge, will be given to registrants whose cancellation is received at least two weeks before the program begins. Refunds will not be issued for cancellations received after two weeks prior to program start.
