DENISE REID HOGGARD We meet in Hot Springs for the 119th Annual Meeting June 1416 with a program of continuing education, a forum for conversations on important hot topics, an opportunity to learn from legal giants, and to hear messages from our governor, legislators, educators, and our attorney general. We will also be inspired and informed by our new Chief Justice Dan Kemp. You are sure to be inspired, encouraged and challenged to set high standards for your continued service as officers of the court. The Arkansas Bar Association represents all practice areas and settings across the state. It is the voice of Arkansas lawyers. That voice is strong because you work through the year and your presence at our 119th Annual Meeting is vitally important, especially in these interesting times. To keep our voice strong to protect our courts, it is important we come together and lead together. Arkansas lawyers meeting and working together with Arkansas judges can ensure our judiciary remains a separate branch of our government, that it stays free from undue political pressure—independent from party politics, separate and equal to the General Assembly and the governor. It is so significant that we meet together jointly with the Arkansas judicial council and we appreciate the opportunity this provides for us to work and learn side-by-side. May we never take for granted our fine judiciary and their commitment to the integrity of our justice system. As you stroll through the program, I feel certain you will struggle with the realization that there are simply too many quality programs to be in all of them. Join me in thanking our Annual Meeting chair Dean Emeritus Cynthia Nance.

The Association welcomes Chief Justice Kemp to our joint meeting with the Arkansas Judicial Council. He will present his first “State of the Judiciary Address” on Friday at 11:30 a.m. In an interview published in The Arkansas Lawyer magazine this February, Kemp outlined his plans to lead the Court. Kemp’s goals include strengthening the administration of justice through the use of technology, encouraging better communication with the public and other branches of the government, and improving civility in the legal profession. Chief Justice Kemp was officially sworn in as Chief Justice of the Arkansas Supreme Court on January 1, 2017. He started his law practice in Mountain View following his graduation from the University of Arkansas School of Law in 1976. His service to the judiciary began when he was appointed as municipal judge in 1977. He held this position until he was elected circuit judge for the Sixteenth Judicial Circuit in 1986, a position he held until the end of 2016. In addition to serving as circuit judge, he served as a drug court judge for 12 years.

Cynthia Nance

Welcome to the 2017 Arkansas Bar Association Annual meeting! This year’s theme is Lawyers Leading in Times of Change. Many of our sessions address important legal issues that are front and center in society today. Building on the 2016 conference, the topics are presented in a manner that will enable you to add to your “knowledge toolbox.” In doing so, we felt it was important to provide you with the balanced perspectives on these cutting-edge matters. And, while many of the topics reflect current societal debates, it is lawyers, representing clients, and the judges who hear those cases, who ultimately determine how those issues will be resolved. We hope that there is something for everyone this year at the Annual Meeting where there are panels on presidential executive orders, refugee resettlement, mental health in the criminal justice system, Islamic law, the death penalty, legal issues confronting transgender individuals and the protection of tribal sacred grounds. We also continue to provide our members with information on the nuts and bolts of practice. Our panels include advice from the bench, ethical social media use, and the impact of new forms of technology on the law. In addition, we are offering topics in substantive areas of the law such as business law, civil rights law, government practice, international and immigration law, real estate law, and tort law, with a full day from both the Criminal and Family Law sections. In

addition, our Young Lawyers Section has planned a track that is geared towards helping newer attorney members build their trial skills, prepare witnesses, communicate effectively with clients, and prepare for appeals. We continue to recognize the importance of diversity of the bench and bar with a highlight session on the proposed changes to the Model Rules of Professional Responsibility. Myles Lynk and Paula Frederick, who played principal roles in advocating for the rule changes, will join Charys Williams to explain the new rule. Judge Waymond Brown and Chief Judge Rita W. Gruber will share their insights on becoming a judge and the Women in the Profession Committee will present a panel on Generational Differences in the Practice of Law— Bridging the Generational Gap. As always, there’s plenty of time to socialize, whether it’s sitting on the veranda at the Arlington or busting a move to Flashback and a special attorney band on Thursday night at the Hotel Hot Springs. Finally, don’t miss the TGIF reception on Friday evening featuring a DJ and photo booth. See you in Hot Springs.

Every firm, regardless of its size, should consider implementing risk management procedures and policies to assist the firm in managing challenges like intake, client screening, conflict checking, ethical compliance, deadlines, client communications, billing, and more. This practical presentation will demonstrate how to conduct an audit of your firm’s risk management procedures and policies and will suggest best practices in risk management. Also learn what caused other attorneys to be sued and how to avoid the “mistakes” they made.

THURSDAY PLENARY

Plenary: A Philadelphia Story: A Conversation with Alan Epstein

12:45p - 1:45p, Thursday, June 15

Alan Epstein, Spector Gadon & Rosen, Philadelphia

This session will feature a conversation with Alan Epstein, former President of the College of Labor and Employment Lawyers, a Philadelphia lawyer who represented a young, gay, HIV positive lawyer in the early 1990s. At the time his client was suffering from full-blown AIDS and the country was grappling with understanding the nature of the disease. Alan’s trial against a prestigious Philadelphia law firm garnered much national publicity as the last federal trial televised on Court TV and CNN, and because it raised many of the issues highlighted at the time by the award-winning movie “Philadelphia” starring Tom Hanks and Denzel Washington. Alan is the Chair of Spector Gadon & Rosen’s Employment Law Practice Group in Philadelphia. He has litigated complex claims before courts throughout the United States. Alan concentrates his practice in civil litigation representation and the provision of transactional advice in the areas of employment rights, civil rights, and constitutional torts. Alan is well known for his participation in high-profile litigation for individuals and corporate entities and for his frequent representation of local and national sports figures, broadcast personalities, and officers and directors of large national corporations.
